ADDENDUM: 

Driver Rights and Entitlements Under Washington State Law:

 

WASHINGTON WORKERS COMPENSATION

Recent laws that were passed by the Legislature in Washington State governing TNC companies took effect January 1st, 2023. Under these laws, Drivers driving on Moovn’s platform in Washington State will be eligible for Workers Comp. Moovn Drvier operating in Washington State will effectively be entitled to workers compensation as “covered workers”. Under this legal mandate, Washington drivers will have access to workers compensation benefits insurance for injuries sustained ONLY WHILE DRIVING WITH A RIDER OR CUSTOMER.

Moovn will deduct a small percentage of the Driver’s Earnings for every Completed Rides ride and allocate it towards Washington’s Labor & Industries Workers Comp System. Please note that the newly instroduced law and statewide protections only covers RIDESHARE DRIVERS who perform driving services for passengers in Washington State. WASHINGTON PAID SICK TIME

You will accrue one hour of paid sick time for every 40 hours spent DRIVING A PASSENGER TO THEIR DESTINATION in the state. Please note that ACCRUAL WILL NOT APPLY when you are online waiting for ride requests (Period 1) or When enroute to Riders pickup location (Period 2). 

You may use accrued paid sick time for the following reasons:

 

PAID SICK TIME ELIGIBILITY & EXCEPTIONS:

PAID SICK TIME IS ONLY ELIGIBLE TO MOOVN DRIVERS OPERATING IN THE STATE OF WASHINGTON, USA. DRIVERS OUTSIDE OF WASHINGTON STATE OR FOREIGN COUNTRIES ARE NOT ELIGIBLE.  

Drivers may be eligible for accrued paid sick time during deactivation of services on our platform with some expectations. DRIVERS WILL NOT BE ELIGIBLE FOR PAID SICK TIME WHEN DEACTIVATED DUE TO ONGOING INVESTIGATIONS OR VERIFIED ALLEGATIONS REGARDING SEXUAL OR PHYSICAL ABUSE.

During a deactivation or other status that prevents you from performing services on the platform, subject to some exceptions. If you become inactive Driving on the Moovn platform for a period of more than 365 days (1 year), your accrued balance will reset to zero (0) and you will lose all access to any accrued balances or paid sick time benefits.

 

INSTRUCTIONS ON HOW TO REDEEM PAID SICK TIME:

Washington Drivers will be eligible to request paid sick time once you have accrued enough hours. To redeem, you must have a balance of at least 4 hours in addition to having provided at least one COMPLETED RIDE in Washington State within a period of 90 days. In simple calculations; One Paid Sick Time Hour is worth your Total Earnings Divided by your Total Time Taken with a Rider in your vehicle (Period 3), throughout the past 12 calendar months. You will only be able to redeem 4 hour increments of Paid Sick Time based on your accrued time until balance depletes.

WASHINGTON GUARANTEED MINIMUM RATES

All trips that originate in Washington State driver will earn the following minimum rates;

Base Fare of $3.26/trip + Per Minute Rate: $0.37/min + Per Mile Rate: $1.27/mile, regardless of whether the trip ends within or outside of Washington State. 

For trips that originate within the City of Seattle, drivers will earn the following minimum rates; 

Base Fare of $5.62/trip +Per Minute Rate of $0.64/min + Per Mile Rate of $1.50/mile, regardless of whether the trip ends within the City limits or Outside City Limits.

Different rates may apply for any trips originating OUTSIDE of Washington State or City of Seattle depending on Fare Zones or Rates computed for those locations. For trips that originate outside of Washington State City of Seattle but conclude within Washington State or City of Seattle limits, the same rates specified above may apply or additional fees may be added to satisfy portions of State or Municipal Regulations or Mandated Rates. WASHINGTON RIDE CANCELLATION POLICY

 

Drivers in Washington State will need to strictly adhere to the following steps for any dispatched pickups in order to receive a cancellation fee;

 

Please note that you may NOT receive a cancellation fee if Rider Reports a Driver Conduct or Safety Issue. If you are matched with a new customer pickup while you already have another passenger in your vehicle, you won’t be eligible for any cancellation fees because you’ll be paid for that time and mileage based on your active ride. 

 

PROTECTION FROM COMPANY RETALIATION: 

Under the new law; Drivers have the right to protection from retaliation for exercising in good faith the rights outlined in this notice, including, but not limited to, retaliation for lawful use of paid sick time and other rights related to paid sick leave.

 

RIGHT TO TAKE LEGAL ACTION: 

The Law also gives Drivers the right to pursue legal action or file a complaint with the Washington Department of Labor & Industries (L&I) for a RideShare Company’s failure to honor the guaranteed rates or for retaliation.

 

VOLUNTARY & MANDATORY DEDUCTIONS: 

Rideshare companies may only deduct from a driver’s compensation under certain conditions. Some deductions require a written advance agreement between the rideshare company and the driver.

The following deductions may be made without a driver’s prior written authorization:

Voluntary deductions may be made, but only when the driver authorizes the deduction in advance and in writing, such as:

Transportations network companies cannot financially benefit or profit from any VOLUNTARY or MANDATORY deductions by the Driver.

Other Deductions that are NOT PART OF DRIVER COMPENSATION include Moovn’s Technology & Booking Fees that are charged directly to the customer and deducted by Moovn Per Ride. Moovn will provide an itemized receipt of rides performed including gross income including Moovn Commission Fees Deductions statement to driver on a weekly basis.

Note: Beginning July 1, 2024, rideshare companies must collect a $0.15 per trip fee from passengers to go towards the Driver Resource Center fund to support the driver community. For shared trips, the fee is collected and paid by the passenger for each portion of an individual trip. Drivers may authorize a rideshare company to take deductions from their compensation for the Driver Resource Center fund.

 

DRIVER RECEIPTS & WEEKLY TRIP NOTICES

Within 24 hours of completion of each dispatched trip, Moovn will provide an electronic receipt to the driver for each trip or portion of a unique trip via a comma separated value (CSV) file or searchable PDF. The receipt must include:

TIPS PROTECTION:

Drivers are entitled to receive all of their tips paid by customers on our platform. Moovn will not use tips to satisfy the minimum rate requirements or any outstanding payments due by Driver. 

 

TOLLS & SURCHARGES:

Tolls, Fees and Surcharges Paid that are mandated and Paid out to the Driver will not be counted as part of Driver Compensation.

GENERAL DRIVER POLICY & TERMS OF SERVICE

 

By providing Services as a Driver for MOOVN, you represent, warrant, and agree that:

 - You possess a valid driver’s license and are authorized and medically fit to operate a motor vehicle and have all appropriate licenses, approvals and authority to provide transportation to Riders in all jurisdictions in which you provide Services.

 - You own, or have the legal right to operate, the vehicle you use when providing Services, and such vehicle is in good operating condition and meets the industry safety standards and all applicable statutory and state department of motor vehicle requirements for a vehicle of its kind.

 - You will only provide Services using the approved vehicle that has been reported to, registered and for which a photograph has been provided to MOOVN, and you will not transport more passengers than can securely be seated in such vehicle (and no more than seven (7) passengers in any instance).

 - You have a valid policy of liability insurance (in coverage amounts consistent with all applicable legal requirements) that names or schedules you for the operation of the vehicle you use to provide Services.

 - You will be solely responsible for any and all liability that results from or is alleged as a result of your provision of Services, including, but not limited to personal injuries, death and property damages, however, this provision shall not limit the scope of MOOVN’s insurance policies.

- In the event of a motor vehicle accident you will be solely responsible for compliance with any applicable statutory or department of motor vehicles requirements, for reporting the accident to MOOVN and your insurer in a timely manner, and for all necessary contacts with your insurance carrier.

- You will comply with all applicable laws, rules and regulations while providing Services, and you will be solely responsible for any violations of such provisions.

- You will pay all applicable federal, state and local taxes based on your provision of Services and any payments received by you.

- You will not make any misrepresentation regarding MOOVN, the Services or your status as an Independent Contractor, or, while providing the Services, operate as a public carrier or taxi service, accept street hails, charge for rides (except as expressly provided in this Agreement), or engage in any other activity in a manner that is inconsistent with your obligations under this Agreement.

- You will not attempt to defraud MOOVN or Riders in connection with your provision of Services. If we suspect that you have engaged in fraudulent activity we may withhold applicable Ride Fees or other payments for the ride(s) in question.

- You will not discriminate or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation. You will make reasonable accommodation for service animals. 

- You agree that we may obtain information about you, including your criminal and driving records, and you agree to provide any further necessary authorizations to facilitate our access to such records during the term of the Agreement.

YOU WILL NOT BE ELIGIBLE TO DRIVE FOR MOOVN IF YOUR BACKGROUND CHECK COMES UP WITH THE FOLLOWING RESULTS;

 

 

 

DISTRACTED DRIVER POLICY

In addition to the terms and conditions outlined above. You are also bound by our universal Distracted Driving Policy which stipulates:

- Drivers are not to be accompanied by any other persons, other than platform employees, while operating the vehicle, except Rider’s guests.

- All Drivers must utilize a hands-free device or Bluetooth technology when using a mobile phone while driving or pull off the road to a safe area if they do not have a hands-free device or Bluetooth technology.

- Drivers are not permitted to use headphones while driving.

 

ADDITIONAL DISCLOSURES

IN ADDITION TO THE TERMS SPECIFIED ABOVE, YOU ALSO AGREE THAT WHILE OPERATING ON THE DIGITAL NETWORK OR SOFTWARE APPLICATION OF THE COMMERCIAL TRANSPORTATION SERVICES PROVIDER, YOUR PRIVATE PASSENGER AUTOMOBILE INSURANCE POLICY MIGHT NOT AFFORD LIABILITY, UNDERINSURED MOTORIST, PERSONAL INJURY PROTECTION, COMPEREHENSIVE, OR COLLISION COVERAGE, DEPENDING ON THE TERMS OF THE POLICY.

IF THE VEHICLE THAT YOU PLAN TO USE TO PROVIDE COMMERICIAL TRANSPORTATION SERVICES FOR MOOVN HAS A LIEN AGAINST IT, YOU MUST NOTIFY THE LIENHOLDER THAT YOU YOU WILL BE USING THE VEHICLE FOR COMMERCIAL TRANSPORTATION SERVICES WHICH MAY VIOLATE THE TERMS OF YOUR CONTRACT WITH THE LIENHOLDER.
